Steps to fill personal injury claims after an accident in Singapore?
Personal injuries refer to any damage arising from the actions of another party. These include workplace injuries, at-fault accidents, negligent medical treatment, etc.

In all personal injury cases, you are entitled to receive compensation for your loss and expenses from the responsible party or insurance company.

Before you can file a claim, you need to prove that your damages and injuries are a direct consequence of the accident. The other party owes you a duty of care and must comply with the contract.

The court passes the final judgment based on the extent of the injury and the accident’s nature. It can also reduce your compensation claim if you are held partially responsible.

Type Of Claims:

You can claim for either general damages or special damages-

  • General damages include losses for the foreseeable future due to the accident. These include suffering, loss of income, or bodily harm. The court estimates the amount for pain and suffering based on the “Guidelines for the Assessment of General Damages.”
  • The compensation amount on the loss of income depends on your time until retirement. The Work Injury Compensation Act (WICA) states the amount you will receive from workplace accidents.
  • Special damages refer to the accident’s expenses, including hospitalization costs, medical bills, repair jobs, etc. The court requires receipts and invoices as evidence. It can also revise your claim if it feels your expenses exceed the necessary measures. Usually, this happens when you pay higher amounts at a private hospital for treatment.

Filing a personal injury claim:-

– Arising from an accident

If you are involved in an accident, notify your insurance agency at the earliest. They open a case and initiate an investigation to cover your expenses.

However, you can hire a personal injury lawyer to ensure your paperwork is in place and receive maximum compensation.

– Claim from a workplace accident

For any workplace accidents, you do not require a lawyer’s assistance to file a claim.

Submit a report to WICA along with a medical certificate and invoices. Also, notify the Ministry of Manpower regarding the same.

You or your associate can file the claim. In case of long-term or permanent incapacity, the MoM requires you to undertake a medical assessment to evaluate the extent and prescribe your compensation.

Under WICA, you need to file a report within a year from the date of the accident.

In other cases, you can file a claim within three years from the date of the incident or when you learned of the injury.
